The issue of sexuality is often taboo in the institutional environment. Either the staff lack any understanding and consideration for the human emotions and needs we all share, or they are uncomfortable with sexuality and would rather avoid having to address it at all. This session highlights the legal and human considerations, offering common sense approaches to addressing a sensitive aspect of person-centered care.

Learner Objectives:

  1. Demonstrate an understanding of the regulatory requirements relative to Residents’ Rights for privacy, dignity, and choice in matters of sexual expression;
  2. Define “capacity” to make decisions according to Michigan Law – who can make what decisions when;
  3. Create policy and procedure that supports compliance and quality care, addresses capacity and the special considerations for residents with dementia, mental illness or other cognitive or intellectual deficit; and
  4. Develop staff education and training programs that ensure sensitivity and appropriate accommodation of the human need for sexual expression.
10:30 AM - 11:30 AM
Ambassador Ballroom (Amway Grand Plaza Hotel)
Grant Pecor, Miller Canfield

Think a minor tweak in employment law won’t rock your world? Think again. Even the smallest changes can set off ripple effects that keep administrators, DONs, and HR teams awake at night. In this fast-paced (and only slightly sarcastic) update, attorney Grant Pecor will walk you through the latest legal shifts most likely to hit your facility and, more importantly, how to stay one step ahead. Expect frank explanations, real-world examples, and a few eye-rolls at the absurdities of bureaucracy. You’ll leave with strategies to minimize liability, policies that actually work in the real world, and a clearer view of how small compliance wins can prevent big operational disasters. Bonus: you might even laugh while learning about employment law.

Learner Objectives:

  1. Spot recent legal developments and explain how they ripple through staff management.
  2. Untangle policies around employee absences and liabilities without losing your sanity.
  3. Compare current operational practices to new mandates and identify smart (and simple) updates to stay compliant.
